Legislative REPORT CARD

 

Realtors, Home Owners and Tax Payers across the country and here in Wisconsin, have benefited from the donations made by all Realtors across the country. This is a glimpse of some of the good things made possible in 2009 with the use of our National Realtor Association RPAC donations in 2009, as posted by our local Board of Realtors.  

Legislation Passed:

  • $8000 Home Buyer Tax Credit for primary residence that does not require repayment.
  • Banks permanently restricted from entering the real estate business.
  • Extended the current limit on property tax increases for municipalities and counties for another two years
  • A state budget that included no increase in the general income tax rate; no general sales tax rate hike, no sales tax on commissions.

Legislation Defeated:

  • Restriction of the mortgage interest deduction as proposed by President Obama.
  • Proposed doubling of the real estate transfer tax that would cost your sellers hundreds of dollars on the sale of their home.
  • A proposal to change the definition of "agricultural land" for purposes of use-value assessments to exclude any land that was platted or zoned for residential, commercial or industrial use. This would have greatly increased housing costs to buyers and carrying costs for owners.
  • A budget proposal to completely repeal Wisconsin's tax break on capital gains (60%), costing investors $485 million over two years.
  • The governor's proposal to force a defendant, who is as little as 1% at fault in a lawsuit, to pay up to 100% of the damages if the other defendants are unable to pay. This would have involved REALTORS® in never-ending lawsuits. ("Joint and Several" provision).
  • A $15.2 billion plan to provide a state government run universal healthcare plan, with a 4% employee payroll tax and a 10.5% employer tax.

 2 items I am particularly please about are banks being restricted from entering the Realty Business and also stopping a hike in the transfer taxes paid when selling a home.

This post does a great job in pointing out the Top 10 items you need to understand about the First Time Home Buyer Tax Credit Offer!

8000 Tax CreditTime is running out for the new home buyers...

Your $8000 reasons to buy a new home will expire on November 30, 2009.

FIRST TIME HOME BUYERS TAX CREDIT TOP 10 LIST

  1. Amount of Credit - 10% of purchase price, not to exceed $8,000
  2. Eligible Property - Single family residence (principal residence)
  3. Not Refundable- Reduces or eliminates income tax liability, will receive refund for unused amount
  4. Income Limit - Single taxpayers with income up to $75,000 and married couples with incomes up to $150,000 qualify for the full tax credit
  5. First Time Home Buyer - Purchaser and Purchaser's Spouse may not have owned a principal residence in three years previous to purchase
  6. Revenue Bond Financing - Purchasers who utilize revenue bond financing can use credit
  7. Repayment - no repayment for purchases on or after January 1st, 2009 and before December 1st, 2009
  8. Recapture - If home is sold within three years of purchase, entire amount of credit is recaptured on sale. Applies only to homes purchased in 2009
  9. Termination - Program expires on December 1st, 2009
  10. Effective date - Effective as of January 1st, 2009 

Finding a house takes time but also don't forget that these items require time (usually about 45-60 days)to process a transaction:

  1. Finding a Realtor whom you trust and who will best represent you 
  2. Writing an offer
  3. Offer acceptance and negotiations
  4. Finding a Lender
  5. Loan application
  6. Survey
  7. Inspections
  8. Repairs
  9. Appraisals
  10. And other issues which often come from lenders, title companies etc...

Buyer's what are you waiting for?

First time home buyer stimulus offer of a free $8000 is soon to expire on November 30, 2009. I have to ask what are many buyers waiting for? This is almost a free 10% of the purchase price on most Viroqua Homes. There are a few limitations such as you have to spend at least $80,000 to get $8,000, live in the home at least 3 years and some income limitations apply. If you want to go house hunting to take advantage of this opportunity you need to understand that time is running out.  

So get going and give us a call at 800-851-8711 now, to set up an appointment to see if you qualify for this benefit! For example this Viroqua home is only $64,900. It is less that the required spending amount but you can get back an estimated $6400 if you act now. If you want to spend less you still get money and this one is still a great buy.  We can guarantee that the payments on this home are way less then most rents in Viroqua!

The Interior: As in most houses of the era, built approximately around 1930, the first room one enters is the living room. It is a pleasant surprise; it's much larger, spacious and open than you might expect. Market Watch August '09

The price range went from a low of $52,400 to a high of $285,000. What do you get for the money? At the low end of the price range is a 2-bedroom 1-bath REO in Viroqua, which is a fixer upper 2-story home. The listing remarks say: DON'T MISS OUT ON THE OPPORTUNITY TO HAVE THIS VALUE PRICED 2 BR/1 BATH BUNGALOW IN CENTRAL VIROQUA. BRING YOUR IDEAS & UPDATE THE KITCHEN & BATH. HARDWOODS, FORMAL DR, LARGE YARD, FULL BASEMENT, NATURAL GAS FURNACE & MORE. PROPERTY SOLD ''AS IS'' PRE-APPROVAL LETTER & EARNEST $ REQUIRED W/ OFFER. ALLOW TIME FOR RESPONSE. Over on the higher end of Vernon County property for sale, is a country property with 45 ACRES M/L.  The Agent's remarks are: LOOKING FOR A WELL MAINTAINED AND UPDATED 4+ BDR, 2 BA HOME? EXPERIENCE COUNTRY LIVING ON 45 ACRES M/L OF MOSTLY CROPLAND/PASTURE. THE HOME IS LIKE NEARLY NEW AS IS WAS GUTTED AND REDONE 12 YEARS AGO PLUS AN ADDT BUILT ON OUTSIDE BLDGS INCLUDE BARN, 2 TOBACCO SHEDS, AND CEMENTED 30X60 POLE BARN W/ LEAN-TO BARN, SILOS, AND CHICKEN COOP. Sold MLS Listing for the Month of June totaled 9 the price range was from a $57,000 for a 3 bedroom, 2 Bath sale in Viroqua, which sold in 74 days. The high sale for July was another Viroqua home but it was a custom ranch home. Both of these sales were REO or know as Real Estate Owned by a Bank.  Sold for $209,900.

What were the chances?

Here is one for the anything can happen in Real Estate book. We have a home listed, receive an offer and we are waiting for our sellers to stop by on Friday to present the offer. From the prior phone conversation it sounded likely, that these sellers would be accepting this offer. If nothing else, it was more than likely, a modest counter offer could be the out come; seems like a simple deal.

Things did not turn out that simple and they really weren't that normal either. You see, the seller's change of heart was not because of a short sale, not because of a foreclosure and not even a because of a nasty divorce preventing this sale from going through to a potential closing.  So want was the Reason?

Thursday night, apparently they won the lotto! I got a call letting us know that now they would not likely be accepting the offer.  They said they would need some additional time to think things over and figure out what exactly to do about the place. Since they won $70,000 cash in the Badger pick 5 game.  It was certain that they would have to pay even more taxes if at this time they sold their second home, so it might be best to wait.  Of course we could always do a counter offer and change closing day to January 1st 2010.

So what were the chances, they were actually about 120 million to 1. It is great to the one who won...
