Tails U Win

More realty drama, please be the judge. I finished up a conversation with a buyer who called me and wanted to see my listing. We set up the appointment. This particular buyer was to call me back the next day to confirm the showing worked with the wife's schedule by the end of the next afternoon. Before that happened, the next morning there is a voice mail from another agent. Pretty much her message goes like this. "Hi Mary, I see you have a listing at E4660 XYZ lane and I have some buyers who I am showing another property to over on K, I even believe you had talked with them, well I am their agent, we assume you have a lock-box etc... bla bla bla...well we don't need you there. If you would get back to me on this."  At the time I talked with this fellow, he had told me he was looking at another home on K, which check out with the other agent's voice mail.  I asked at the time of this buyer, is it listed? Who is showing it to you? He said he did not know the name of the agent and did not know the company of the agent or anything about her at all, basically could not remember. Well, I let him know that if he didn't know the agent name and she later wanted to show him my listing it was now going too be late, was that a problem, the answer was no. Because of this, I called the cell of the agent and let her know I would be showing the home, not her.

 Fast forward to the end of that day. Now, the broker owner of this agent gives me a call.(I am a broker owner too). He goes right into an ambush and tirade about how all us RE/MAX agents must have all been taught all the dirty tricks, etc... I was totally stunned by his comments and rather taken back. I just asked him to fax me a copy of the buyer agency agreement, as I don't need to fight over a buyer. It never came. Well I just let her show the home anyway because I really didn't care. I am blessed; I am always busy. Sure enough she does write an offer, but it's a really low, low-ball, of course, also wants the seller to pay all inspections and gift a 4% down payment to boot. Repeat Lesson learned over and over again, not all buyers are worth the time to drive out to the house for.  This offer is so bad it should be rejected, but we are going to counter offer. Why you might ask? Because I have also learned along time ago, that those who scream the loudest are never capable of realizing why they are so wrong.

 Back to why I am blessed, I am willing to work long and hard hours.  Plus, I always analyze the odds. In Real Estate the odds seems to often be only 50/50. They either like it or they don't. Do you think Realtors are good gamblers or is it that the odds are frequently just a flip of the coin?

JoEllen, Yes I agree, fighting is such a waste of time. If the offer had been better, that would have also been great.

Good for you for taking the high road.....even in times where business may not be where we like it, you have to be the person you are and not the person someone else wnats you to become.

Hi Dan, Yes it is the high road that is the easiest to take, it really is better for everyone. This offer most likely will fail due to terms and price. As to the drama, I can get past that stuff it is over.

Hi Mary, sounds like it was a frustrating experience.  You did right by asking for the buyers rep agreement.  Hopefully, that got them thinking on their side.  In my opinion, I don't want to work with buyers that are not going to be loyal to me.  Just think, you saved some gas money. 

If you get the house sold for you seller, mission accomplished.  Best of luck.  Sondra

Mary, I agree not worth a fight. I always let a client make their own choices. if they found a realtor they want to work with then so be it. Good for you for taking the high road.

Sounds as if you probably saved yourself some time and effort.  The potential buyer should also realize they'd be better off if you'd showed it to them.  You might be willing to try harder to get it through.

Today's buyers are really difficult and not the most trustworthy.

Because of this I have been trying to get every first meeting with a new buyer at my office with a loan officer. I then explain the benfits of buyer agency, and hav them preapproved. While they are speaking with the Lender I print off all matching properties and ask which ones we should set up showings for.

If they sign with me great, if they don't I won't get my hopes up. That is really where the 50/50 comes in. And I decide if I want to take the gamble or not. I'm sick of getting stood up by buyers I don't know.

I have to say you sound like a stand up kind of gal. Good for you . Buyers sometimes just have no clue how the real Estate world works. it is up to the buyers agent to explain that at the first meeting. Sounds like you got the better end of the deal anyway...

Sondra: Yes even in a small market is pays to at lease ask if they have looked at any home with other agents.

Barbara: As today the offer failed, buyers won't go up and sellers won't go down. end of deal. I might have save $6.00 in gas, Yippee!

Andrew: that is so good to do, I haven't had to, but see it is time to start that practice.

Sharon: Thanks that was a nice compliment, in this case it was actually the other agent who did not have a clue, since she did not search for anyother homes her buyer would be interested in before they called me.

We just had a similar situation in NH. Our come back was we'll let a hearing panel decide who is procuring cause. No sense fighting over it at this point. You’re doing the right thing in my opinion by encouraging a counter offer from your seller.

Monika, Yes it was not worth the trouble as the buyer withdrew their offer when countered. I was not surprised.

I've had this happen to me before too... It's disgusting how some people can manipulate buyers, they obviously were on their own when they called you and got sucked into a situation that they probably didn't understand.

You took the high road!  and should feel good about it.

Debbie you are so right on, I was more annoyed at the balling to her broker and him calling me with such a p%*&* attitude. May I never have a call from that agent again, would be my feelings.
